**Pet Wellness Plans Terms and Conditions**
This agreement (“Agreement”) outlines the terms and conditions governing your enrollment in a Pet Wellness Plan (“Plan”) offered by (“the Clinic”). By enrolling in a Plan, you (“the Client”) agree to be bound by these terms:
1. Nature of the Pet Wellness Plan
1.1. The Pet Wellness Plan is a proactive healthcare program designed to provide routine, preventative veterinary services for your pet at a predictable monthly or annual cost.1
1.2. This Plan is NOT pet insurance. It does not cover unforeseen accidents, illnesses, emergencies, or conditions not explicitly listed within your chosen Plan tier.
1.3. Pet insurance typically covers unexpected medical events, while this Plan focuses on routine, preventative care.
2. Eligibility and Enrollment
2.1. Each Plan is specific to the individual pet enrolled and is non-transferable to another pet or another person.
2.2. The services and benefits of this Plan are exclusively available Azaiba Veterinary Clinic at and are not transferable to any other veterinary practice.
2.3. To enroll, the Client must complete the application process and provide all necessary information regarding their pet’s health and well-being.
3. Plan Coverage and Services
3.1. Your Plan covers the specific services detailed in the chosen Plan tier (Basic, Comprehensive, or Premium) and the corresponding life stage (Puppy/Kitten, Adult, Senior) as outlined in your enrollment summary.
3.2. All services included in the Plan are subject to the professional medical discretion and clinical appropriateness as determined by the Clinic’s veterinary team. The Client may not request services, treatments, or discounts outside of what is medically appropriate for the enrolled pet.
3.3. Services not explicitly listed in your chosen Plan tier, or services provided by anyone other than Azaiba Veterinary Clinic, are not covered by this Agreement. Fees for such non-included services will be determined by the Clinic’s standard fee schedule at the time they are rendered and must be paid at the time the service is provided.
3.4. Certain Plan tiers may include discounts on additional services, medications, or products not explicitly covered by the Plan. These discounts will be applied as specified in your Plan details.
3.5. Services included in your Plan must be utilized within the current 12-month term of your Agreement. Any unused services will not roll over to a subsequent renewal term.
4. Payment Terms
4.1. The Plan operates on a subscription model, requiring a fixed monthly payment as specified in your enrollment summary.
4.2. The monthly payment is inclusive of applicable taxes. Tax rates are subject to change, and the Clinic reserves the right to adjust monthly payments accordingly without prior notice.
4.3. The cost of veterinary treatments, including vaccinations and drugs, may fluctuate. The Clinic reserves the right to adjust the monthly payments for your Plan. Any such change will be communicated to you in writing with at least 10 days’ notice prior to the effective date, typically coinciding with the renewal of your Plan’s term.
4.4. In the event of non-payment or dishonored payments, the Client may be subject to additional fees as outlined by the Clinic’s payment policies. If payment cannot be collected, the Client may be held liable for the full, non-discounted price of any services received up to that point, minus any payments already made.
5. Duration and Termination of Plan(s)
5.1. The initial term of this Agreement is twelve (12) months from the Plan enrollment date.
5.2. Unless the clinic is otherwise notified, your Plan will automatically renew for successive 12-month periods at the end of the initial term and any subsequent renewal terms.
5.3. Client Cancellation: You may cancel your Plan by providing written notice to the Clinic at least one month prior to the end of your current 12-month term. If you choose to terminate your Plan part-way through a term, you will be retrospectively charged the full, non-discounted price for all products and services received during your membership up to the termination date, minus any fees already paid. Any initial membership fees are non-refundable.
5.4. Clinic Termination: The Clinic reserves the right to terminate this Agreement at any time, with or without cause, by providing written notice to the Client. Reasons for termination may include, but are not limited to, non-payment, misuse of the Plan, fraud, or failure to adhere to the Clinic’s instructions regarding your pet’s health and care. In such cases, a prorated refund may be issued based on the remaining full months of the current membership, less the full, non-discounted cost of services already rendered.
6. Client Responsibilities
6.1. The Client is responsible for scheduling and ensuring their pet attends all necessary appointments and check-ups as recommended by the Plan and the veterinary team.
6.2. The Client must provide accurate and complete information regarding their pet’s health, medical history, and well-being to the Clinic at all times.
6.3. The Client agrees to adhere to all veterinary instructions and recommendations for their pet’s care.
7. Limitations of Liability
7.1. The Clinic will provide services in accordance with normal standards of veterinary care.
7.2. The Clinic shall not be liable for any delay or failure to provide services or Plan benefits due to circumstances beyond its reasonable control, including but not limited to, the absence or illness of qualified veterinary staff, shortages of necessary vaccinations or drugs, or power/technology outages. In such events, the Clinic will make reasonable efforts to minimize delays and reschedule appointments.
8. General Provisions
8.1. This Agreement constitutes the entire understanding between the Client and the Clinic regarding the Pet Wellness Plan.
8.2. If any term or provision of this Agreement is found to be invalid or unenforceable, the remaining terms and provisions shall remain in full force and effect.
8.3. All notices required under this Agreement must be in writing and delivered personally, by traceable mail, commercial courier, or email.
